For prospecting house owners, I have this advice for you learning from my experience, if your house is delivered late:
1. Decline to have any write-off on the interest that you owe to the developer if the amount is much lesser than the amount the developer owes you for late delivery.
2. Make sure you record all dealings in writing. Even after discussions, follow-up with a letter confirming the discussion outcome.
3. Insist on your full rights according to the S&P agreement. The developer tried to 'cheat' us by informing that their policy and practice is such and such... but if the policy and procedure is not in the S&P, the developer's policy will remain their policy and not binding to you. What counts are the terms agreed in the S&P.
Though we still have yet to obtain our late payment, Alhamdulillah, we have had rezki by having an immediate rentor. The 'funny' thing is, the rentor is the developer too (LBS marketing arm) to make our house their site office.
